2.2 User Eligibility

• Users must be at least 18 years of age.
• Users must have the legal capacity to enter into a contract.
• Commercial use of services is subject to a separate agreement.

3. Formation of the Contract

3.1 Registration

• Accurate information must be provided during registration.
• Only one account per user is allowed.

3.2 Pricing and Payment

• Payments are processed via Stripe. Please refer to their privacy policy for details on how they handle personal data.

4. User Obligations

4.1 Acceptable Use

Users are prohibited from:

• Infringing intellectual property rights.
• Creating illegal or offensive content.
• Attempting unauthorized access to services.
• Sharing account credentials with others.

4.2 Content Responsibility

• Users are responsible for the content they generate.
• Illegal, harmful, or discriminatory content is strictly prohibited.

5. Intellectual Property

5.1 Ownership

• Users retain ownership of the content they generate.
• MyAICat retains a license to use the content for service improvement purposes.

5.2 Licensing

• Users grant MyAICat a non-exclusive, revocable license to use their generated content.
• Commercial use of the content is subject to separate terms.

6. Limitation of Liability

6.1 Liability Scope

• Liability is limited to direct damages only.
• The maximum liability is the amount paid for the service or €500, whichever is greater.
• We are not liable for indirect or consequential damages.

6.2 Warranty

• Services are provided "as is" with no guarantees of specific outcomes.

7. Data Protection

• Personal data is processed in accordance with our privacy policy.
• Users' rights concerning their data are respected.
• Appropriate data security measures are in place to protect user information.

8. Termination

8.1 User Termination

• Users may cancel their subscription at any time.
• No refunds will be issued for partial periods if the subscription is canceled.

8.2 Platform Termination

• MyAICat reserves the right to terminate services at its discretion.
• Termination may occur due to:
  • Violation of these terms of service.
  • Suspicious activity on the account.
  • Compliance with legal requirements.

9. Dispute Resolution

• We strive to resolve disputes amicably.
• In case of disagreement, arbitration in Germany is preferred.
• Small claims court is also an option for dispute resolution.

10. Miscellaneous

10.1 Modifications

• These terms may be updated at any time.
• Users will be notified of significant changes to the terms.

10.2 Severability

• Invalid provisions will be replaced with valid alternatives.
• The remaining terms will remain unaffected.

11. Governing Law

These terms are governed by the laws of Germany.
